Introduction

The?Legal Theory Lexicon?series usually explicates some concept in legal theory, jurisprudence, or philosophy of law. But what are those fields and how do they relate to each other? Is ?jurisprudence? a synonym for ?philosophy of law? or are these two overlapping but distinct fields? Is ?legal theory? broader or narrower than jurisprudence? And why should we care about this terminology?

As always, this entry in the?Legal Theory Lexicon?series is aimed at law students, especially first-year law students with an interest in legal theory.

Who Cares About Terminology

Why should we care about terminology? Who cares what goes under the label ?jurisprudence? or ?philosophy of law? or ?legal theory?? Well, of course, there is a sense in which we shouldn?t care at all. What matters in a deep way is the?substance?of theorizing about law. On the other hand, these labels are important for a different reason?because their use tells us something about the?sociology?of the academy. When people argue about what ?jurisprudence? really is, the terminological dispute may reflect a conflict over ?turf? and ?authority.?

Disciplinary Lines and Theorizing About Law

Very broadly speaking, the turf of high-level legal theory is disputed by at least four groups. First and (still) foremost are the academic lawyers, those whose graduate-level training is exclusively (or almost exclusively) in law as it is taught in the legal academy. Second, there are the economists?some of whom are primarily (or exclusively) trained in economics while others learn their economics in law school. Third, there is the ?law and society? movement?broadly defined as the study of law from a social science (but noneconomic) perspective. Law-and-society theorists may have been trained in political science or sociology or criminology, but many may have been trained in the legal academy as well. Fourth, there is the law-and-philosophy movement, with ?analytic legal philosophy? or "analytic jurisprudence" as the focal point of a variety of philosophical approaches. Many "philosophers of law" have formal philosophical training, but some were trained in law or political theory in a political science department. ?There are other approaches to the study of law (e.g., "law and courts" scholarship in political science dpeartments), but for the most part they do not claim to be doing "legal theory" or "jurisprudence."

So, what about the turf wars? Those who use the phrase ?philosophy of law? tend to be philosophers, while the term ?jurisprudence? is more strongly associated with the legal tradition of theorizing about the law, but there is frequently a blurring of the these two terms. From the 1960s on, a single figure had a dominant influence in defining the content of ?philosophy of law? courses in philosophy departments and ?jurisprudence? courses in the law schools?that figure was?H.L.A. Hart. Of course, there were many, many exceptions, but for quite a long time the standard course in both disciplines included as a central, organizing component, an examination of Hart?s ideas, either?The Concept of Law, Hart?s great book, or the Hart-Fuller debate in the Harvard Law Review. When I was a student in the 70s and early 80s, I thought that ?jurisprudence? and ?philosophy of law? were synonymous?and that both were references to analytic philosophy of law in the tradition of Hart and included figures like Dworkin and Raz. One consequence of the ?philosophicalization? of jurisprudence was the move to fold moral and political philosophy into jurisprudence. I have a very clear memory of browsing the law shelves of the textbook section of the UCLA bookstore in the mid to late 70s, and discovering John Rawls?s?A Theory of Justice?and Robert Nozick?s?Anarchy, State, and Utopia?as the texts for the jurisprudence course. I have always assumed that similar courses were offered elsewhere, although I could be wrong about that.

Philosophy is important as a matter of the sociology of the legal academy, but it is not the only important interdisciplinary influence: economics, political science, and sociology, each of these also has a major influence. Given that the ?jurisprudence? course was ?captured? by philosophers, how could these other approaches to legal theorizing express their theoretical framework in the law school curriculum. One mode of expression was the alternative theory course??Law and Economics? and ?Law and Society? were the two leading competitors of ?Jurisprudence.? Moreover, the tradition of distinctively legal thinking about high legal theory remains. American Legal Realism was largely the product of the law schools?although many other disciplines figured in the realist movement. Likewise, Critical Legal Studies was largely a phenomenon of the legal academy. Some jurisprudence or legal theory courses incorporate philosophy of law, law and economics, and law and society into a course that is taught from a distinctively legal point of view.

What can we say about our three terms?jurisprudence, philosophy of law, and legal theory?

Jurisprudence

My sense is that most Anglo-American legal academics view ?jurisprudence? as mostly synonymous with ?philosophy of law?. This is not a unanimous view. There is still a lingering sense of ?jurisprudence? that encompasses high legal theory of a nonphilosophical sort?the elucidation of legal concepts and normative theory from within the discipline of law. Moreover, in other legal cultures, for example, in Europe and Latin America, my sense is that the move to identify jurisprudence with philosophy of law never really took root.

Philosophy of Law

The meaning of the phrase ?philosophy of law? is inevitably tied up in the relationship between the two academic disciplines?philosophy and law. In the United States and the rest of the Anglophone world, ?philosophy of law? is a subdiscipline of philosophy, a special branch of what is nowadays frequently called ?normative theory? and closely related to political philosophy.? Of course, there are many different tendencies within academic philosophy generally and the philosophy of law in particular. Still, the dominant approach to philosophy of law in the Anglophone world is represented by ?analytic jurisprudence,? which might be defined by the Hart-Dworkin-Raz tradition on the one hand and by the larger Austin-Wittgenstein-Quine-Davidson-Kripke tradition on the other.? (In both cases, the list of names is arbitrary and illustrative--we could add Coleman or Finnis or drop Davidson or Wittgenstein and still refer to the same set of central tendencies.)

Coexisting with the analytic tradition in the philosophy of law are many other philosophical approaches. These include Hegelianism, neo-Thomism, Marxism, as well as the contemporary continental philosophical tradition, ranging from Habermas (with close affinities to the analytic tradition) to Foucault and Derrida (with much more tenuous links).

The philosophy of law covers a lot of ground. An important line of development focuses on the ?what is law?? question, but much contemporary legal philosophy is focused on normative questions in specific doctrinal fields. The application of moral and political philosophy to questions in tort and criminal law is an example of this branch of contemporary legal philosophy.

My sense of the "lay of the land" is that debates over the "What is Law?" question have recently become more exciting (Scott Shapiro's work is just one example)--but in my opinion the center of attention has shifted from the nature of law to normative legal theory.? A variety of potentially exiting developments that are very recent include the emergence of experimental jurisprudence and explorations of the connections between metaethics and metajurisprudence.

Legal Theory

Legal theory is a much broader and encompassing term, encompassing the philosophy of law and jurisprudence as well as theorizing from a variety of other perspectives, including law and economics and the law and society movement. In my opinion, ?legal theory? is currently the bestneutral?term for referring to legal theorizing, broadly understood. It allows us to avoid the turf wars and sectarian disputes that make the word ?jurisprudence? somewhat problematic.

Conclusion

When you start theorizing about law, you are likely to adopt some term or phrase to describe your activity. ?I?m doing jurisprudence,? or ?I?m a philosopher of law.? I hope that this entry in the?Legal Theory Lexicon?will help you use these labels with some awareness of their history and the controversies that surround their use.

DSI to call in military snipers

Police said they have evidence and will soon summon military snipers for an inquiry into their role in the crackdown on red-shirt protesters in 2010, according to the deputy Metropolitan Police chief.

Pol Maj-Gen Anuchai Lekbamrung on Sunday said police investigators had evidence in certain cases to identify armed members of an army sniper unit who may have had a role in causing injury and deaths in the 2010 violence.

Police will summon them to further investigate who should be held accountable for the 92 dead civilians and soldiers. Police investigators will hold a joint meeting with Department of Special Investigation officials on Monday to discuss how to proceed with the case. DSI director-general Tarit Pengdith?and his deputy will also attend the meeting.?

The DSI will decide on which army snipers are to be called for questioning which will take place at the agency, Pol Maj Gen Anuchai said.

Pol Maj Gen Anuchai, who heads the investigation, was speaking after the Prime Minister's Office recently appointed 50 police officers to the DSI as "investigators for special cases" related to the 2010 events.

Third time's a charm? Diana Nyad launches new attempt at record swim from Havana to Florida

HAVANA - Third time's a charm?

Endurance athlete Diana Nyad launched another bid Saturday to set an open-water record by swimming 103 miles (166 kilometers) from Havana to the Florida Keys without a protective shark cage.

Under a blazing afternoon sun at the Hemingway Marina in the Cuban capital, Nyad adjusted her cap and goggles, pointed to the open water, blew a bugle and cried: "Adios amigos! Courage!" Then she leaped in feet first and stroked out toward her support boat.

Less than a week before she turns 63 years old, the Los Angeles woman is attempting a feat that even the fittest of human beings would find daunting. It's a dream that has taken three years of marathon open-water training swims and multiple aborted attempts at the crossing.

In the summer of 2010, unfavorable weather kept her from even setting out. Last year, first a debilitating asthma attack and then painful, dangerous stings from box jellyfish forced her from the water on two separate attempts.

This time Nyad is banking on a custom-made swimsuit to protect her from the jellyfish. It covers her head-to-toe with a pantyhose face and holes only for the eyes, nose and mouth.

It's non-buoyant but still creates drag in the water, so she hopes to don it only at night when jellyfish are more likely to rise to the surface.

"You have to learn from your mistakes. You don't do it the first time," Nyad said at a news conference, deeply tanned with goggle-rings around her eyes. "We need some luck, but we do feel like we've solved all the problems."

On her second try last summer, Nyad lasted 41 hours before calling it quits. She estimated it will take at least 60 hours to complete the swim to the Keys, and said the Straits of Florida were forecast to remain calm in the coming days.

Go-time had been planned for Sunday around dawn, but shifting weather forecasts prompted a last-minute change. The water north of Havana was slightly choppy Saturday, but expected to quiet down.

"This isn't perfect. You can go out and see some little whitecaps," Nyad said. "But I feel strong in the beginning, so why not get a few hours out and tonight it's going to calm."

In June, Australian endurance swimmer Penny Palfrey made it 79 miles of the way before throwing in the towel in the face of strong currents.

A fiercely driven competitor, Nyad acknowledged it was hard to watch Palfrey come close to snatching away her long-held goal.

"If she had succeeded I would have congratulated her, because I know how difficult it is, more than anybody. And after all, this is not my ocean," Nyad said. "But it is my dream. ... Frankly ? how can I lie? ? I'm glad that I still have the chance to be first."

Nyad first tried to cross the Straits of Florida in 1978 as a 28-year-old, but fell short.

For that attempt Nyad swam inside a steel cage, which she said not only protects from sharks and softens the waves but even creates a current that propels a swimmer forward.

On her third bid at a cageless swim, a 50-person support team including navigators, weather gurus and a shark handler from Australia were accompanying Nyad on five vessels. She planned to take short, periodic breaks for rest and nourishment.

In lieu of a cage, a kayaker will paddle alongside dangling an apparatus in the water that creates an electrical field designed to repel sharks. A team of shark handlers will carefully scan the surrounding waters from the roof of her main support boat, ready to dive in and gently nudge away any predators that make it through the shield.

Nyad confessed to sleeping poorly the night before and to feeling nerves, in addition to confidence, as she set out: "My heart is going to beat fast because this is history in front of me."

After falling short in the past she has vowed not to try again, but each time the siren call of the Straits proved too great.

Asked whether she would make another attempt if the weather, currents and marine life all cooperate but she is physically not up to the task, Nyad did not categorically rule out a fourth try.

But she suggested that even she has a limit.

"Sitting here, I can't address that," Nyad said. "I have to say, it's too much. I've asked too many people to put in too much. We know what we're doing. This has to be it. It just has to be."

Nyad set a world mark for open-water swimming without a wetsuit in 1979 by crossing 102 miles from the Bahamas to Florida.

A writer, journalist and motivational speaker, she said she hopes to inspire people of all ages to live active lives.

"Instead of staying on the couch for a lifetime and letting this precious time go by, why not be bold?" she said. "Be fiercely bold, and go out and chase your dreams."

Court sentences Russia rockers to 2 years

Three members of the Russian feminist punk band Pussy Riot remain in jail after a performance in protest of Vladimir Putin in a Moscow cathedral. NBC's Michelle Kosinski reports.

Updated at 11:29 a.m. ET: MOSCOW -- ?A judge sentenced three women who staged an anti-Kremlin protest on the altar of Moscow's main Russian Orthodox church to two years in jail each on Friday in a trial seen as test of President Vladimir Putin's tolerance of dissent.

The trio from punk band Pussy Riot, handcuffed in a courtroom cage, reacted with giggles and one rolled her eyes when the judge issued the sentences after reading the guilty verdict for almost three hours.


A man in the courtroom shouted "Shame!" and hundreds of protesters outside the Moscow courthouse repeated that chant and whistled when news of the sentence came.

"They are in jail because it is Putin's personal revenge," opposition leader Alexei Navalny said in the courtroom. "This verdict was written by Vladimir Putin."

Nadezhda Tolokonnikova, 22, Maria Alyokhina, 24, and Yekaterina Samutsevich, 30, were convicted of hooliganism motivated by religious hatred for performing a "punk prayer" in Moscow's Christ the Savior Cathedral. They called on the Virgin Mary to rid Russia of Putin.

Their feminist punk collective has about 10 members who appear in public in ski masks for anonymous impromptu performances they describe as a form of protest art.

The defendants said they were protesting against close ties between Putin and the Russian Orthodox church and did not intend to offend believers, but the judge rejected those arguments.

The U.S. Embassy in Russia criticized the sentences.

"Today's sentence in the Pussy Riot case looks disproportionate to the actions," the U.S. Embassy in Russia wrote in Russian on Friday on its Twitter microblog.

Prosecutors had requested three-year sentences. The two-year sentences include the nearly six months served since the defendants were jailed following the Feb. 21 protest.

In a sign of the tension over the trial in a small Moscow courtroom, Judge Marina Syrova was assigned bodyguards on Thursday following what authorities said were threats.

Divisions
The trial divided Russia's Orthodox Christians, with many backing the authorities' demands for severe punishment, but others saying the women should be granted clemency.

The trial featured a parade of state witnesses who say they were traumatized by the church performance, which prosecutors called an abuse of God.

Russia's Pussy Riot: Unmasked and on trial

Ahead of the verdict, their lawyers said the outcome will be dictated by the Kremlin. Putin's supporters denied that and portrayed the women as blasphemers and self-publicists who should be punished for committing a premeditated outrage against the Church.

Members of Pussy Riot were found guilty Friday after staging this protest on Feb. 21, 2012, inside Christ The Savior Cathedral in Moscow.

"It was a conscious deed. They understood quite clearly where they were going and why," said Vladimir Burmatov, who represents Putin's United Russia party in parliament.

Pussy Riot was formed last year in anger at Putin's decision to return to the presidency in an election after four years as premier. The band's public performances were popular on the Internet, but it is the trial that has brought them global fame.

The charges against them raised concern abroad about freedom of speech in Russia two decades after the collapse of the Soviet Union.

Pop star Madonna has joined the chorus of criticism over the trial of a Russian women's punk band accused of religious hatred. The three women face years in jail after mounting a protest against Vladimir Putin on the altar of the country's main cathedral. It's part of a widening government crackdown on dissent. ITV's Paul Davies reports.

Small, but raucous protests were held Friday in a few dozen cities in support of the three women. A few dozen people came out in Barcelona, Spain, a couple hundred in Paris, and a handful in Washington. Other rallies were held in Bulgaria, Ukraine and elsewhere.

The opposition says Putin saw the trial initially as a chance to strengthen his relationship with the influential Russian Orthodox Church -- about 70 percent of Russians say they follow the faith -- but his plans backfired.

Although believers were united in outrage that the band thrashed out a "punk prayer" deriding Putin in a place they consider sacrosanct, many were upset by the Church hierarchy's lack of forgiveness and calls for "divine retribution."

Many Russians, including some of the Orthodox faithful, are concerned about ties between church and state under Patriarch Kirill, who has praised Putin's rule as a "miracle of God."

Aware that a long sentence could reinforce the picture Pussy Riot has painted of him as intolerant and repressive, Putin told reporters this month that although the women had done "nothing good," they should not be judged too harshly.

But the damage to Putin's image abroad has already been done, and divisions between his supporters and opponents have widened, risking polarizing society even more than when protests took off against his 12-year-rule during the winter.

The Fall 2012 Dance Schedule has been released! If you are interested in getting more active, or want to continue to develop your skills in the world of dance, then come and check out Lauriers Special Interest Classes. We are offering a variety of programming this Fall, including beginner and intermediate level classes, as well as unique classes such as Highland and Acro. Programming will run Monday-Thursday evening at the Athletic Complex for the duration of the Fall term. Come and try our free week from September 17th-September 20th and see which program is the best fit for you! All of our dancers get to participate in the Dance Showcase at the end of the term to show off their dedication, hard work and great routines.

Wilfrid Laurier University?s Department of Athletics & Recreation is home to varsity sports as well as numerous intramural, recreation & fitness programs. Over 6,000 students at Laurier participate in 30 intramural sports and 40 recreational programs annually.

All Fitness and Recreational classes and instruction require an additional fee to assist with the instructional component to the class. Registration takes place early in the term through an online process.
